Privacy Policy

Sim Savant

This Privacy Policy describes how SJC Ventures, LLC, a Minnesota limited liability company operating under the trade name “Sim Savant” (“Sim Savant,” “we,” “us,” or “our”), collects, uses, discloses, and protects information about you when you access or use the Sim Savant website at sim-savant.com (the “Website”), the Sim Savant application (the “App”), the Sim Savant Discord community (the “Discord Server”), and all related products, features, and services (collectively, the “Service”).

By accessing or using the Service, you consent to the data practices described in this Privacy Policy. If you do not agree to this Privacy Policy, do not access or use the Service.

1. Information We Collect

(1) Information You Provide Directly.

When you create an account, subscribe to the Service, or otherwise interact with us, you may provide the following information:

  • Name (first name and, optionally, last name)
  • Email address
  • Account password (stored in encrypted form; we do not have access to your plaintext password)
  • Discord username or user ID (for linking your Sim Savant account to Discord access)
  • Communications you send to us (e.g., support requests, feedback, inquiries)
  • Customer Content you upload (e.g., DFS lineup configurations, CSV files of contest results, similar DFS-related data)

(2) Information Collected Automatically.

When you access or use the Service, we automatically collect certain information, including:

  • IP address
  • Device information (browser type, operating system, device type, screen resolution)
  • Usage data (pages or features visited, actions taken, time spent, click patterns, referring URLs)
  • Log data (server logs of requests, error messages, timestamps)
  • Cookies and similar tracking technologies (see Section 5)

(3) Information from Third Parties.

We may receive information about you from third parties, including:

  • Stripe, Inc.: payment confirmation information (transaction IDs, amounts, dates, payment success/failure status). We do not directly receive or store your full credit card number, expiration date, or CVV; Stripe processes and stores this information separately.
  • Discord, Inc.: information necessary to verify your subscription status for premium channel access (such as your Discord user ID and server membership status). Other information about your Discord activity is governed by Discord’s own privacy policy.

(4) Information We Do Not Collect.

We do not directly collect the following information from you (although third-party service providers may collect it for their own purposes):

  • Full credit card numbers, expiration dates, or CVV codes (handled by Stripe)
  • Phone numbers (Stripe may collect these for payment verification)
  • Mailing addresses (Stripe may collect these for payment verification)
  • DFS platform account credentials (we do not integrate with DraftKings, FanDuel, or other DFS platforms via direct account access)
  • Social Security Numbers, driver’s license numbers, or other government identifiers
  • Health information

2. How We Use Information

(1) Operating the Service.

We use information to provide, maintain, and improve the Service, including:

  • Creating and managing your account
  • Providing access to subscription features based on your subscription status
  • Processing payments through Stripe
  • Verifying your eligibility for Discord premium channels
  • Providing customer support and responding to your inquiries
  • Storing and processing your Customer Content
  • Generating personalized analytics and recommendations

(2) Communications.

We use your contact information to:

  • Send transactional communications (account confirmations, billing notices, password resets, security alerts)
  • Send updates about your subscription (renewals, payment failures, plan changes)
  • Send Service announcements (new features, maintenance windows, important changes)
  • Respond to your inquiries and support requests
  • Send marketing communications, where permitted by law and only if you have not opted out

(3) Analytics and Improvement.

We use information to:

  • Understand how users interact with the Service
  • Identify popular features and areas for improvement
  • Diagnose and fix bugs
  • Monitor performance and reliability
  • Develop new features and services
  • Generate aggregated, de-identified statistics about Service usage

(4) Security and Fraud Prevention.

We use information to:

  • Detect and prevent fraud, abuse, and unauthorized access
  • Investigate violations of our Terms of Service
  • Protect the security and integrity of the Service and our users
  • Comply with our legal obligations

(5) Legal Compliance.

We may use information as required by law, court order, or governmental request, or as necessary to comply with legal obligations.

3. How We Share Information

(1) Service Providers.

We share information with third-party service providers who help us operate the Service. These providers are bound by confidentiality obligations and are permitted to use your information only to provide services to us:

  • Stripe, Inc. — payment processing (privacy policy: https://stripe.com/privacy)
  • Vercel, Inc. — application hosting and deployment (privacy policy: https://vercel.com/legal/privacy-policy)
  • Supabase, Inc. — database and authentication services (privacy policy: https://supabase.com/privacy)
  • Discord, Inc. — community platform (privacy policy: https://discord.com/privacy)
  • Email service providers — for sending transactional and marketing emails
  • Analytics providers — for understanding Service usage patterns

(2) Legal Disclosures.

We may disclose information when we believe in good faith that disclosure is:

  • Required by law, regulation, legal process, or governmental request
  • Necessary to enforce our Terms of Service or other agreements
  • Necessary to protect the rights, property, or safety of Sim Savant, our users, or others
  • Necessary to detect, prevent, or address fraud, security, or technical issues

(3) Business Transfers.

If Sim Savant is involved in a merger, acquisition, sale of assets, financing, or similar corporate transaction, your information may be transferred as part of that transaction. We will notify you of any change in ownership or use of your personal information.

(4) Aggregated and De-Identified Information.

We may share aggregated, de-identified, or anonymized information (information that cannot reasonably be used to identify you) for any purpose, including for research, marketing, or business intelligence.

(5) With Your Consent.

We may share information with third parties when you direct us to do so or otherwise consent to the sharing.

(6) What We Do Not Do.

We do not sell your personal information to third parties. We do not share your Customer Content with other users of the Service. We do not engage in cross-context behavioral advertising of your personal information to unaffiliated third parties for monetary or other valuable consideration.

4. Data Retention

(1) Active Accounts.

We retain information associated with your account while your account is active and as needed to provide the Service to you.

(2) Account Closure.

Upon account cancellation or termination, we will delete your account data within ninety (90) days, except as required to retain for the following reasons:

  • Legal compliance (e.g., tax records, accounting records)
  • Resolution of disputes or enforcement of agreements
  • Backups maintained as part of standard data protection practices (eventually overwritten in normal retention cycle)
  • Aggregated or de-identified information that cannot reasonably be linked back to you

(3) Stripe Records.

Stripe retains transaction records according to its own data retention policies and applicable financial regulations. We have limited control over how Stripe retains payment information.

(4) Discord Records.

Information in the Discord Server is also subject to Discord, Inc.’s data retention policies. We may delete records of your interaction with our Service’s Discord integration, but Discord itself may retain records of your activity on its platform.

5. Cookies and Tracking Technologies

(1) What Are Cookies.

Cookies are small text files placed on your device when you visit a website. They enable us to recognize your browser and remember certain information.

(2) Types of Cookies We Use.

We use the following types of cookies:

  • Essential cookies: required for the Service to function, including authentication and security. These cookies cannot be disabled without breaking core functionality.
  • Functional cookies: enable personalized features (e.g., remembering your preferences, settings, or login state).
  • Analytics cookies: help us understand how users interact with the Service. These may include third-party analytics tools.

(3) Managing Cookies.

You can manage cookies through your browser settings. Most browsers allow you to refuse cookies, delete existing cookies, or be notified when cookies are set. Note that disabling certain cookies may impact your ability to use some features of the Service.

(4) Do Not Track.

Some browsers offer a “Do Not Track” (“DNT”) signal. There is currently no industry-standard interpretation of DNT signals. The Service does not respond to DNT signals.

6. Data Security

(1) Security Measures.

We implement reasonable administrative, technical, and physical safeguards designed to protect your information from unauthorized access, alteration, disclosure, or destruction. These include encryption of data in transit (HTTPS/TLS), access controls, secure password storage, and regular security reviews.

(2) Limitations.

No security measures are perfect or impenetrable. Despite our efforts, we cannot guarantee absolute security of your information. You are responsible for maintaining the security of your account credentials and for notifying us promptly of any unauthorized access.

(3) Data Breaches.

If we become aware of a data breach that materially affects you, we will notify you and take appropriate remedial action as required by applicable law.

7. Your Rights and Choices

(1) Account Information.

You may access, update, or correct certain account information at any time by logging into your account or contacting us at support@sim-savant.com.

(2) Marketing Communications.

You may opt out of marketing emails by clicking the “unsubscribe” link in any such email or by contacting us. You cannot opt out of transactional emails necessary for providing the Service (e.g., account confirmations, billing notices).

(3) Account Deletion.

You may request deletion of your account by contacting us at support@sim-savant.com. We will delete your account data within ninety (90) days, subject to the retention exceptions described in Section 4.

(4) Cookies.

You may manage cookies through your browser settings as described in Section 5.

(5) State Privacy Rights.

Depending on your state of residence, you may have additional rights regarding your personal information, including the rights described below. To exercise any of these rights, contact us at support@sim-savant.com.

8. California Privacy Rights

(1) California Consumer Privacy Act (CCPA).

If you are a California resident, you have the following rights under the California Consumer Privacy Act (“CCPA”) and the California Privacy Rights Act (“CPRA”):

  • Right to know: request information about the categories of personal information we collect, the sources, the purposes, and the categories of third parties with whom we share it
  • Right to access: request a copy of your personal information
  • Right to delete: request deletion of your personal information, subject to certain exceptions
  • Right to correct: request correction of inaccurate personal information
  • Right to opt out of “sales” or “sharing” of personal information (we do not sell personal information and do not engage in cross-context behavioral advertising for monetary consideration)
  • Right to limit use of sensitive personal information (we collect only limited sensitive information, such as account credentials)
  • Right to non-discrimination for exercising your rights

(2) How to Exercise Your Rights.

To exercise any of these rights, contact us at support@sim-savant.com. We will respond within forty-five (45) days, with possible extension as permitted by law. We may need to verify your identity before responding.

(3) Authorized Agents.

You may designate an authorized agent to exercise your CCPA rights on your behalf. The agent must provide written authorization signed by you, and we may verify the agent’s identity and authority.

9. Other State Privacy Rights

If you are a resident of another U.S. state with applicable privacy laws (including but not limited to Virginia, Colorado, Connecticut, Utah, Texas, and others as they become effective), you may have similar rights regarding access, correction, deletion, and portability of your personal information. 10. Children’s Privacy

The Service is intended for adults 18 years of age and older. We do not knowingly collect personal information from individuals under 18. If we learn that we have collected personal information from a person under 18, we will delete that information promptly. If you believe that we have collected information from a person under 18, please contact us at support@sim-savant.com.

11. International Users

The Service is operated from the United States and is intended for users located in the United States. If you access the Service from outside the United States, your information will be transferred to, stored, and processed in the United States. By using the Service, you consent to this transfer. The privacy laws of the United States may differ from those of your country of residence.

12. Third-Party Links and Services

The Service may contain links to third-party websites, services, or content (such as DFS platforms like DraftKings or FanDuel, Discord, or social media). We are not responsible for the privacy practices of these third parties. We encourage you to review the privacy policies of any third-party services you use.

13. Changes to This Privacy Policy

(1) Updates.

We may modify this Privacy Policy at any time. If we make material changes, we will notify you by email (to the address associated with your account) or by posting a notice on the Service at least thirty (30) days before the changes take effect.

(2) Acceptance.

Your continued access to or use of the Service after the effective date of the modified Privacy Policy constitutes your acceptance of the modified Privacy Policy.
